How to effectively engage an expert witness

Expert witnesses can bring a tremendous boost of credibility to courtroom arguments for a plaintiff or for a defense.  That’s why it is vital to choose a top expert witness and use them appropriately for a particular case and legal issue.

Here are some things to consider when choosing an expert witness:

What are their qualifications?  Make sure the expert witness has impeccable educational credentials and experience that are relevant to the issue at hand.

Will they have a positive effect on the jury?  They may be smart above reproach, but if their manner is uncomfortable, or their mannerisms and demeanor are condescending, then the expert witness may work against your side of the case.  Expert witnesses must also be able to withstand cross-examinations and courtroom pressures.  They must be prepped just like any other witness.

Can you defend the witness against claims of bias?  When an expert witness gives overwhelming testimony for one side of a case, they open themselves up to charges of bias.  Making sure this bias can be addressed is a key point to consider.

Is the expert witness already a recognized resource?  Sometimes, when an expert witness is a known entity in the legal system, this can work in your favor.  Other times, the witness risks over-exposure, or their strengths and weaknesses are already a known quality to the judge and the other side of the case.

Availability and compatibility.  Can the expert witness devote the time and resources to adequately prepare to represent a side in a case?  The expert witness should also be someone who you can effectively work with under the pressures of a trial situation.
